Kapipal Inc. (“Kapipal”), a US corporation, takes your privacy seriously. The below outlines our privacy policy that we have committed to in order to protect your personal information.

This document is the “Privacy Policy” of the site and is addressed to all those who use the web services of Kapipal which are available in the net by entering the above address.

People under 18 are not permitted to use Kapipal on their own, and so this privacy policy makes no provision for their use of the site.


  • Surfing data The computer systems and software used by the site, acquire certain personal data in the normal course of the service, which is implicit to be able to use the Internet communications protocols. It is data that does not enable us to identify the user, for example, name, address and e-mail address, unless the user expressly supplies this. This category includes the IP addresses or the computer domain names used by users who connect to the site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to make the request to the server, the size of the file supplied in answer, the numeric code relative to the answer given by the server (successful outcome, error, etc.) and other parameters relative to the operating system and the environment used by the user. This data is cancelled immediately after processing and is used exclusively for anonymous statistics data relative to the use of the site and to check it is working correctly. The data could also be used to investigate responsibility in the event of computer crimes that damage the site; apart from this possibility, the data relative to the web contacts is not stored for more than seven days.
  • Cookies A “cookie” is a small text file transferred by the web server to the user’s computer. Its aim is to inform the server regarding user access to a particular web page and other news obtained from the system’s legible parameters via functions contained in the web page. Cookies can be “temporary” (or session cookies, cancelled at the end of the connection) or “permanent” (memorized on the user’s hard disk unless the user cancels them). This site uses session cookies and persistent cookies in order to: (i) keep an anonymous trace of surfing sessions; (ii) improve surfing within the site; (iii) personalize services; (iv) analyse, in aggregate form, site traffic models. The persistent cookies we use can only store personal identification data if the user has registered or granted authorisation for the personal data input to be stored. Otherwise, our server merely recognises that a non-identified visitor, with that particular cookie, has reconnected to the site. This data is not communicated to third parties and is not diffused. The user can, depending on the browser being used, disable or select to accept or refuse the use of cookies. In this case surfing cannot be as easy, some site functions may not be available and some web pages may be visualised incorrectly.
  • Memberships and Registration In order for you to register for our Services, we may require you to provide us with information such as a name, email address, state and country of residence, zip/postal code, birth date and gender. Some areas of the Services may allow you to visit as a guest and remain anonymous, but you may not be able to access all the content and features of those areas without registering (in order to participate in our Site, additional information, such as your real name and billing information, may be required). You may be asked to choose a user or member name and password. Please do not use your real name or the real name of another person when selecting a user name
  • Data freely supplied by the user The optional, explicit and voluntary sending of e-mails to the addresses given in the site, means that the sender’s address is automatically acquired, as it is needed to answer the request, together with any other personal data given in the message. Specific brief information notes will be shown in the site pages relative to special services that are requested.


Apart from the data required for surfing, the user is free to supply the personal data requested in the Kapipal registration form if they wish to receive informative material and other communications. Failure to supply said data could mean it is impossible for us to satisfy their request. Furthermore, in certain cases (which do not fall under normal site management) the Authorities could request news and information, for the purpose of controlling the personal data processing; in this case we are obliged to respond with risk of administrative sanctions if we fail to do so.

In those cases where access to reserved areas of the site requires a “email” and a “password”, it is your responsibility to keep these reserved and to immediately inform us should unauthorised persons use them.


Any personal information or content that you voluntarily disclose in public areas becomes publicly available and can be collected and used by other users. You should exercise caution before disclosing your personal information via these public venues.


By entering into our User Agreement, Kapipal Fundraisers (Kapipalists) agree to not abuse other users’ personal information. Abuse is defined as using personal information for any purpose other than those explicitly specified in the Kapipalist’s Project / campaign page, or is not related to fulfilling delivery of a product or service explicitly specified in the Kapipalist’s Project / campaign page.

Kapipalists never receive users’ credit card information.


The personal data is automatically processed for the time strictly needed to fulfil the purpose the data was collected for.

Special security measures are observed to prevent data loss, illegal or incorrect use and unauthorised access, as required by law regarding the minimum security measures that must be applied.

We use a variety of security measures, including encryption and authentication tools, to maintain the confidentiality of your personal information. Your personal information is stored behind firewalls and is only accessible by a limited number of people who are required to keep the information confidential.

Regardless of these efforts by us, no data transmission over the public Internet can be guaranteed to be 100% secure.

Furthermore, to enable us to supply you with a complete service, our portal contains links to other web sites, which are not managed by us. We are not responsible for errors, contents, cookies, publishing the contents, advertising, banners or files that do not conform to current legislation in force and the Privacy Law by sites that are referred to but not managed by us.


Any processing connected to this site’s web services (physical hosted on a web server situated with AWS servers, US & Europe) is carried out on the premises of the company that owns the server, on behalf of the data controller and is only handled by employees, collaborators or partner employees, or by other occasional maintenance operators.

No data that is acquired from our Web services will be notified or divulged to others; any personal data the users supply us with further to their specific requests, is used exclusively for the service requested by them and is only notified to third parties in those cases where it is strictly necessary for the service (see the chapter optional data supply).


The “owner” of the processing of any personal data taken further to consulting our site is Kapipal.


At any moment, the person the personal data refers to has the right to receive confirmation as to whether the data exists, its contents and the source, to check the data is exact and request it be integrated, updated or changed.

Under the terms of the same article, the person concerned has the right to ask for the data to be cancelled, to be made anonymous or to block any data that is processed in violation of law, and to refuse it being processed for legitimate reasons. In this case, requests should be sent by email


We may occasionally update our privacy policy and respective statement to reflect changes in our Web Site and the Services. When we post changes, we will update the effective date at the top of this statement. If changes to our privacy policy are material, we will notify you either by prominently posting a notice of such changes prior to implementing the change or by directly sending you a notification. We encourage you to periodically review our privacy policy and to be informed of how Kapipal is protecting your personal information.


Fraud does exist on the Internet. Kapipal will fully cooperate and work with law enforcement to track any fraudulent activity or fraudulent transactions. By entering fraudulent information, the person committing fraud has authorized their ISP to supply Kapipal with whatever information Kapipal needs to pursue and cooperate with a criminal investigation.

You have the right to request a copy of the information we are processing about you.

You have the right to have incomplete or inaccurate information that we process about you rectified.

You have the right to request that we delete information that we process about you, except we are not obliged to do so if we need to retain such data in order to comply with a legal obligation or to establish, exercise or defend legal claims.

You have the right to restrict our processing of your information where you believe such data to be inaccurate; our processing is unlawful; or that we no longer need to process such data for a particular purpose unless we are not able to delete the data due to a legal or other obligation or because you do not wish for us to delete it.

You have the right to obtain information we hold about you in a structured, electronic format, and to transmit such data to another data controller, where this is (a) information that you have provided to us, and (b) if we are processing that data solely on the basis of your consent or to perform a contract with you.

Where the legal basis for processing your information is our legitimate interest, you have the right to object to such processing on grounds relating to your particular situation. We will abide by your request unless we have compelling legitimate grounds for the processing which override your interests, or if we need to continue to process the data for the establishment, exercise or defence of a legal claim.

If you have consented to our processing of your information, you have the right to withdraw your consent at any time, free of charge. This includes where you wish to opt out from marketing messages. You can make a request to exercise any of these rights in relation to your information by sending the request to us via email on our support page. For your own privacy and security, at our discretion, we may require you to provide your identity before providing the requested information. Please note that Kapipal may take up to 30 days to fulfill such requests.
